SoundGym, Inc. ('ToneGym', "Company", 'we', 'our' or 'us'), provides access to the ToneGym platform across web and mobile applications. We respect your privacy and are committed to protecting your information.
This privacy policy governs your use of the ToneGym software application for the web, mobile devices, and our iOS and Android applications. We collect personal identifiers, musical performance data, and device usage statistics to provide personalized ear training and synchronized progress across devices. As ToneGym is a social platform, certain profile information like your username and musical achievements may be visible to other members of the community. We do not sell your personal data to third parties.
We process personal data only when we have a legal basis (e.g., to perform a contract, comply with law, for legitimate interests, or with your consent). If you disagree with any term provided herein, you may not use ToneGym.
When you access or use the ToneGym Application we are aware of your usage of ToneGym, and may gather, collect and record the information relating to such usage. For example, when you connect to ToneGym, your computer or device tells us your IP address, your country, your timezone and more.
1.1 Registration
When you create an account, and sign up with email or with your google or apple accounts, we may collect your personal information, such as your username, first and last name, and email address.
1.2 Information you added to your Profile Page
When you add pictures, music, studio gear, and any other information about yourself on your profile page.
1.3 Data collected through the use of the Service
After you set up your account and while using ToneGym, we may ask and you might provide us other profile and demographic information. We also collect information about your activity performance, TPI (ToneGym Performance Index), and achievements on ToneGym.
1.4 Info from your browser
Such as country, timezone, device, browser type and so on.
1.5 Mobile Hardware Permissions (Microphone)
To provide specific ear-training features (such as Sight-Singing and Solfègiator), the App requests access to your device's microphone. This audio data is processed locally in real-time for pitch detection and is never recorded, stored, or transmitted to our servers.
1.6 Activity on site
We use third-party analytics tools, such as Google Analytics and Amplitude, to help us measure traffic and usage trends for the Service. These tools collect information sent by your browser or mobile device, including the pages you visit, features you interact with, your use of third-party applications, and other information that assists us in analyzing and improving the Service.
2.1 Information is collected in order to enhance the User's experience on ToneGym, and to learn about the preferences of users and general trends on ToneGym (e.g. understand which features are more popular than others).
2.2 We may use your email for updates and tips on ToneGym's products and services, and for activities notifications. You can unsubscribe at any time in your account settings.

Analyze and improve the Service.
Personalize and enhance your experience on ToneGym.
Enable the overall operation of ToneGym across Web, iOS, and Android.
Enable you to connect and communicate with other users.
Identify you when conducting customer service operations (such as providing feedback, etc.).
3.1 ToneGym is a social platform. To encourage engagement and communication most of the information you provide, your activity and your achievements on ToneGym are public and can be seen by anyone: your name, your profile picture, your ranking, your achievements, and your activity on ToneGym (Including but not restricted to workout completion, personal records, days on the platform, completing a learning program, winning a contest). Your posts, comments, and probes are public. Anyone can see who you follow and who is following you. Other data, images, links or music that you upload, provide or post might be available publicly.
3.2 You can choose to make your profile information hidden in your account settings. Please note that certain information, such as your awards, posts and other social remarks, will still be public or visible to ToneGym members.
3.3 Users who follow you will get notifications regarding your activity and achievements on ToneGym.
3.4 In the event that we are involved in a bankruptcy, merger, acquisition, reorganization, or sale of assets, your personal data may be sold or transferred as part of that transaction.
3.5 We share or disclose non-personal data, such as aggregated information.
4.1 Web Payments:
Payments made via our website are processed through secure third-party providers (PayPal/Bluesnap). We do not store your credit card or full financial details on our servers.
4.2 Mobile In-App Purchases:
Payments made through our iOS or Android applications are processed by Apple (App Store) or Google (Play Store). These transactions are subject to the respective privacy policies and terms of Apple and Google. We do not have access to your full credit card details for these transactions.
5.1 You must be signed in to your account in order to delete it. You can delete your account via the Settings menu in the mobile app, or via the website here.
5.2 Please bear in mind that, if you delete your account, data associated with your account will be deleted and will not be recoverable. Posts that you wrote cannot be deleted, but they will not be referred to you anymore.
5.3 Our deletion policy upholds a user's right to always remove their own account data, while protecting against account fraud and the deletion of data without an account owner's consent.
5.4 We don't have control over the deleted account link showing up in Google's search results. If you have deleted your account, Google should catch up and recognize this soon. However, as they cache search results for faster loading times, they may keep your information in their search results if enough people have clicked on it in the past. To fully remove your profile/information, you will need to contact Google directly by filling in this public removal form.
We will share Personal Information only in the following cases: (a) to satisfy any applicable law, regulation, legal process, subpoena or governmental request; (b) to enforce these Privacy Policy or the Terms of Use governing the use of ToneGym, including investigation of potential violations thereof; (c) to detect, prevent, or otherwise address fraud, security or technical issues; (d) to respond to claims that any content published on ToneGym violates any right of a third-party; (e) to protect the rights, property, or personal safety of the Company, its Users or the general public; (f) when Company is undergoing any change in control, including by means of merger, acquisition or purchase of all or substantially all of the assets of Company; (g) pursuant to your approval, in order to supply certain services you have requested from Company (h) to use third-party analytics tools (specifically Google Analytics and Amplitude) that help us measure traffic, track user behavior, and understand usage trends for the Service.
7.1 What is a cookie?
Also known as browser cookies or tracking cookies, cookies are small files placed onto your computer or mobile device that enables ToneGym features and functionality.

We use cookies and other technologies to ensure everyone who uses ToneGym has the best possible experience. Cookies also help us keep your account safe. Essential cookies are required; optional cookies are only set after opt-in. By continuing to visit or use our services, you are agreeing to the use of cookies and similar technologies.
7.3 What types of cookies does ToneGym use?
We use Persistent cookies (which help us recognize you as an existing user so you don't have to log in every time) and Session cookies (which last only as long as the current visit).
7.4 How ToneGym use cookies?
Cookies can be used to recognize you when you visit ToneGym, remember your preferences, and give you a personalized experience. We use Google Analytics and Amplitude to gather statistical and behavioral information. This is done to understand user engagement, ensure the Products are available when you want them, and improve the overall performance of the platform.
We use the Google AdWords remarketing service to advertise on third party websites (including Google) to previous visitors to our site. Third-party vendors, including Google, use cookies to serve ads based on someone's past visits to ToneGym website. We also use Meta Pixel to advertise on Meta platforms according to pages that you have visited or your performance on ToneGym. Any data collected will be used in accordance with our own privacy policy and the third-party's privacy policy.
We take a great care in maintaining the security of ToneGym and your information and in preventing unauthorized access to it through industry standard technologies and internal procedures. However, we do not guarantee that unauthorized access will never occur.
While using ToneGym you may encounter links to third party websites. Please be advised that such third party websites are independent from ToneGym, and we assume no responsibility or liability whatsoever with regard to privacy matters or any other legal matter with respect to such third party websites.
11.1 We do not knowingly collect Information from children under the age of 16 without parental consent. If you are a child under 16 years of age, you are not permitted to use the Services and should not send any Information about yourself to us through the Services.
11.2 If we become aware that we have collected Information from any child, we will delete that Information. If you are a parent or guardian and you believe that your child under the age of 16 years has provided us with Information without your consent, please contact us and we will take reasonable steps to ensure that such Information is deleted from our systems.
The terms of this Privacy Policy will govern the use of ToneGym and any information collected therein. Company reserves the right to change this policy at any time, so please re-visit this page frequently. Changes to this Privacy Policy are effective as of the stated "Last Revised" date.
